USER AGREEMENT
THE FOLLOWING SETS FORTH THE TERMS ON WHICH this venue owned by Tizaworld, Inc. OFFERS ACCESS TO OUR SERVICE. USE OF THIS SERVICE CONSTITUTES USER\'S AGREEMENT WITH THE TERMS AND CONDITIONS AS DESCRIBED. WE RESERVE THE RIGHT TO MODIFY OR CHANGE THESE CONDITIONS AT ANY TIME. AUCTION BIDDING PROCEDURES & RULES 1) REGISTRATION: All bidders must register to receive a User ID and Password in order to bid online. You can register online by clicking on the Register Now link found on various pages throughout our web site. You may also register by phone. Once registered, your User ID and Password will be valid for all future Sterlingbids.com sales unless your account is closed for violation of sterlingbids.com policies. Internet registration is available 24 hours, however, final credit approval may take up to 72 hours to complete (accounts with inaccurate information are suspended). Any restrictions on the amounts new bidders may bid will be made at the discretion of the auction management. New bidders may be asked to provide credit card information as guarantee of payment. 2) BIDDING: Bidding begins immediately upon the launch of the auction on our web site. Preliminary bidding will end at the stated time for each auction. a) Online Bidding - Online bidding for registered users who have obtained a User ID and Password is available 24 hours. 3) Currently there are two main sections on the auction venue. Storefronts where the timer begins on an item once it is bid on and the main venue where all auctions start at $1 with no reserve. 4) Bidding increments are determined by the auction house. There are no exceptions to the bid raise amounts unless changed by sterlingbids.com. 6)BID STATUS NOTIFICATION emails are sent to notify users they have been outbid. Sometimes due to server errors, these emails may not arrive. It is up to the bidder to make sure he/she is the winning bidder at the end of the auction. 8) Sterlingbids.com is a auction venue owned by Tizaworld inc. We are a venue only and cannot take responsibility for third party sellers not delivering items and take no responsibility for the condition, merchantability, content, accuracy or any other element relating to to third party seller\'s items. By registering you agree to hold us harmless for any circumstances resulting from your transactions with third part sellers on sterlingbids.com. We have a strict verification program to reduce fraud and will respond to customer complaints, but can take no financial responsibility for others actions through the sterlingbids.com auction medium. Sellers who receive several complaints in the course of one month will have their accounts closed until these complaints are resolved. 9) Costs for packaging, shipping and insurance (where it applies) will be added to all invoices. Absolutely NO lots will be shipped until full payment is received. Shipping and Handling is determined by the seller and is shown in the auction listing. If you are an International bidder, please ask if there are any extra S&H charges for your item. Every item has the S&H charge included for domestic delivery. 10)Winning bidders and sellers will be notified of the results of an auction via email immediately after the auction closes. 11) Invoices are payable upon receipt with payment due no later than one day from date of invoice. If payment is via Paypal, payments are due immediately upon receipt of invoice (or up to 7 days for those with one or more feedback points only) if you are combining S&H charges, payments later than 7 days will result in immediate
account suspension). Payments may be made by cash, check, M.O. Paypal or Credit Card. Unless known to Tizaworld Inc., personal checks will be held for 30 days before merchandise is approved for shipment. If your account is turned over to a collection agent for non-payment you agree to pay the fees which normally range from $50 to $100.00 unless this is prohibited by your State laws. Furthermore if you fail to pay for an item, you waive your ISP privacy and will allow us to find your true identity for collection purposes. You also agree that the Courts of Oregon will have jurisdiction in collection cases initiated by Tizaworld, Inc. . 13) RETURN POLICY: Returns are accepted with 14 days if the item is not as described. All artifacts are guaranteed unconditionally to be authentic and may be returned at anytime during the life of the owner if they are found ever to be not as represented. 14) We reserve the right to accept or refuse a bid by any bidder for any reason whatsoever. We may suspend a bidders account for abusive or foul language or a non working email account. If you fail to answer a request from accounts@sterlingbidz.com your account will be closed. Any registration that contains false information (Name, phone numbers address etc)will be suspended. We do not share your information with third parties, but we need to be able to verify our members.
(15) If you own or are part owner or represent an online auction venue and you register here to solicit sellers or bidders to that venue or any other venue you agree to a default judgement allowing Tizaworld to become the sole owner of your venue and the domain name associated with that venue. You also agree to a minimum cash judgement of $10,000 on top of any and all other compensation you are forced to pay. This clause does not include simple websites or stores, it is only intended for other auction venues.
If you are registered as a third party seller before your seller account is approved, you must agree to the following terms:
1. You (seller) will not attempt to use the auction venue as a way to sale items outside the auction venue. For example, sending emails to previous winning bidders to drive traffic to your own site or another auction venue is prohibited.
2. Seller will not offer for bid any illegal items.
3. Seller will only sell items in categories that you have been approved for.
4. Seller will not engage in shill bidding.
5. Sellers will not list items that have a value less than the S&H charges. Junk sellers or those using misleading titles will have thier accounts suspended.
6. Seller will ship all items that have been paid for within 5 business days. Proof of mailing is the responsibility of the seller.
7. Tizaworld, inc. may halt any auction without warning at any time.
8. Seller will hold Tizaworld, inc. harmless for any site malfunctions or failures.
9. Tizaworld, Inc. may revoke the third party seller program (certified merchant or seller program) without notice and any time. You agree to hold Tizaworld, inc. harmless of any damages if it at any time decides to close your account or discontinue any sales program.
10. Seller agrees that the credit card on file can be charged for any non paid seller\'s fees.
11. Seller agrees not to link to other websites through his auctions. All third party links are not allowed unless they are for processing payments (paypal.com, bidpay.com)
We reserve the right to modify this agreement. If any part of this agreement is found invalid, Registered users agree to hold the rest valid.
Registering on the site constitutes agreemnent to the above terms.
